Do I need to approach the NBFC's Grievance Redressal Officer (GRO) before sending this notice?▼

It is not a mandatory legal pre-condition, but escalating to the NBFC's GRO first strengthens your case. The RBI requires every NBFC to designate a GRO and respond to grievances within 30 days. If your GRO complaint goes unanswered beyond 30 days, or if the response is unsatisfactory, you may escalate directly to the RBI Ombudsman under the Reserve Bank – Integrated Ombudsman Scheme, 2026 (RB-IOS, 2026) without paying any fee.

No. Under the SARFAESI Act, 2002 (Sections 13(2) and 13(4)), a secured creditor must first issue a 60-day demand notice before enforcing security. BNS Section 351 applies when a recovery agent explicitly threatens a borrower or their family with physical harm, false criminal cases, or arrest. Mere rude or abusive language — while still a violation of the RBI Fair Practices Code — does not meet the threshold for criminal intimidation.
